THE HKSA MISSION

What is HKSA?
We are a social organization that illuminates the Hong Kong culture with various outdoor and indoor activities. At HKSA, we avidly champion the culturally rich blend of traditional legacy and fast-paced modernity.

What do we do?
In the past, we have brought all sorts of Hong Kong entertainment to UC Berkeley students. From the latest movies to delectable cuisines of the Bay Area to physical activities such as camping, HKSA looks forward to enjoying a diverse group of activities with you in the upcoming semester. As the staple of every semester's events, our renowned Semi-Annual Karaoke Contest is a must-go experience, and we are waiting for you to be the next KING OF MAHJONG in our exciting mahjong competition.

CONSTITUTION
BY-LAWS OF

THE HONG KONG STUDENT ASSOCIATION (HKSA) OF

THE UNIVERSITY OF CALIFORNIA AT BERKELEY

Article I. Elections.

1.1 Nominations shall be made at least one week prior to the election date.

1.2 A legitimate candidate group shall consist of a Presidential and Vice Presidential-hopeful.

1.3 All active members and cabinet members will be eligible to vote. Each active member carries one vote. Each cabinet member carries two votes.

1.4 The election shall be held by secret ballot in the last month of the semester.

1.5 An Election Committee shall be formed three weeks before date of election; it shall include the Senior Advisor and the President of current term and one non-running cabinet member, by the consensus of the cabinet. The most recent ex-president shall be included in the Election Committee if and only if either the Senior Advisor is not available or the President runs as an incumbent.

1.6 The Election Committee shall make rules regarding the election that abide this By-Law; their decisions on Election matter is final and shall be respected and adopted by all officers and members of HKSA.

1.7 The Election Committee shall be responsible for verifying the results of the election and publicizing the results to all members of the HKSA, including running candidates.

1.8 In the event of a tie in member votes, the candidates with the majority of the officer votes shall become President-elect and Vice President-elect.

1.9 In the event of a tie in member and officer votes, the Election Committee shall make the final decision.

1.10 In the event of a single candidate group running, the candidates must obtain 50% of votes in order to be elected.

1.11 In the event of a single candidate group running that does not receive 50% of votes, or no candidates are running, the Election Committee shall appoint the President and Vice President.

1.11 Transfer of office shall be completed before the start of the following semester.

Article II. Fiscal Matters.

2.1 All surplus public or private funds shall be retained in the HKSA miscellaneous account for future HKSA office use.

2.2 In the event of dissolution of the HKSA, all unspent ASUC funds shall remain the property of the ASUC. All privately obtained funds must be transferred to a non-profit organization.

CONSTITUTION OF

THE HONG KONG STUDENT ASSOCIATION (HKSA) OF

THE UNIVERSITY OF CALIFORNIA AT BERKELEY

Preamble

The Hong Kong Student Association founds by this Constitution a student organization committed to enhancing student understanding of Hong Kong culture and providing a means of socialization and interaction for all Chinese students, and hereby ordains and establishes this Constitution.

Article I. Title.

1.1 The official title of this student organization shall be the “Hong Kong Student Association,” hereafter referred to as the HKSA.

Article II. Objective.

2.1 The purpose of establishing the HKSA is to provide a means for its members, in particular for Cantonese-speaking students, to socialize and interact and to promote the unique culture of Hong Kong in the University of California at Berkeley.

2.2 In pursuit of fulfilling its purpose, the HKSA shall organize various social and cultural activities on the basis of member interests.

Article III. Membership.

3.1 Only currently registered students, faculty and staff may be active members in the HKSA. Only active members may vote or hold office.

3.2 Non-active members shall include all graduated students and former faculty of the University of California at Berkeley.

3.3 Privileges:

a. All members are entitled to full participation in the activities of the HKSA.

b. All active members are entitled to all rights stated in the Constitution and the By-Laws.

c. All members are to be informed by email of all activities of the HKSA.

3.4 We will not haze according to California State Law; we will not restrict physical and mental disability, medical condition (cancer-related or genetic characteristics), ancestry, marital status, age, sexual orientation, citizenship or status as a covered veteran (special disabled veteran, Vietnam-era veteran or any other veteran who served on active duty during a war or in a campaign or expedition for which a campaign badge has been authorized).

Article IV. Officers.

4.1 The cabinet of the HKSA shall consist of:

a. The President acts as a coordinator and a point of contact for the HKSA; supervises planning and execution of HKSA activities; participates each HKSA activity; speaks in formal receptions; acts as the formal contact of the HKSA; presides over all cabinet meetings.

b. The Vice President assists the president in all HKSA affairs; holds the president position in case of an emergency; participates each HKSA activity.

c. The Treasurer holds responsibilities for budgeting; supervises financial activities of the HKSA; provides a monthly financial report; maintains an accurate accounting record of all HKSA financial activities; provides ASUC with financial reports, holds the office for at least two consecutive terms

d. The Internal Secretary holds responsibilities for keeping records of the officer meetings; compiles minutes for all HKSA-related meetings and circulates them among officers and members; designs and produces all documents related to HKSA events.

e. The External Secretary holds responsibilities for keeping track of membership records; notifies members of current and future HKSA events; updates members’ contact information.

f. The officers of Information Technology must maintain and update the HKSA website, common class list, Mud Gut Sin (online magazine), upload event pictures, and prepare graphic effects for Karaoke Contest and any special events; maintain a historical record (soft copy) of the HKSA.

g. The officers of Planner hold responsibilities for organizing and scheduling HKSA events; devise a thorough plan for HKSA events; present proposals in the officer meeting; conduct any necessary researches; execute the plan with all available resources.

 

h. The officers of Publicity hold responsibilities for promoting HKSA activities through flyers; weekly update the HKSA board; design and produce all promotional item and contents.

i. The E-magazine Editor holds responsibilities for collecting and proofreading articles from cabinet members and active members; updates Mud Gut Sin (online magazine) monthly.

j. The Historian holds responsibilities for taking pictures for each HKSA event; updates HKSA photo album; maintains a historical record (hard copy) of the HKSA

k. The Senior Advisor must be and is limited to ex-president available. The role of this position shall be defined by the current existing President.

* Any of the officers listed above may be assigned tasks and duties not listed in their job descriptions.

4.2 Each office position shall be elected in a publicized and mandatory election meeting held every semester. Officers from the previous semester must attend the election

4.3 Only active members are allowed to be considered as candidates for intern positions. Only active interns are allowed to run for office. Interns must have approval by the President, and other cabinet members through Intern evaluation before they may run for office.

4.4 If any ex-presidents or ex-officers wishes to return to the officer team, the members of the executive office must vote to decide if the ex-presidents or ex-officers are allowed to be instated. A vote of the executive officers is not needed if the ex-president or ex-officer was a member of the officer team in the prior term.

4.5 Elections shall follow the By-Laws.

Article V. Impeachment.

5.1 Any members of the officer team may call for a vote of impeachment of any officers including the President.

5.2 Impeachment of any officers must be decided by a vote of the executive officers

5.3 Impeachment of the President must be decided by a vote of the senior advisor and executive officers excluding the President. In case of the removal of the President from office, the Vice President shall then act accordingly as President until the disability be removed, or a President shall be elected. The President shall have power to appoint a cabinet member to act as Vice President and fill up any vacancies; then such a new form of cabinet office maybe adopted with a favorable two-thirds majority vote of cabinet members present at a cabinet meeting.

Article VI. Meeting and Activities.

6.1 The cabinet meetings shall be held each week.

6.2 Special cabinet meetings may be called by the president.

6.3 Upon a request by any member for special cabinet meetings, the President must consult with the cabinet and decide the necessity of such a meeting.

6.4 General activities are defined as orientation, general meetings, movie nights, and community service. Non-general activities include all activities that are not general activities.

6.5 A Karaoke Contest, defined as a non-general activity, shall be organized each semester. An ad hoc committee can be appointed to organize the Contest.

6.6 The cabinet meetings shall be conducted in Cantonese. Meeting minutes shall be provided in English.

Article VII. ASUC

7.1 The Constitution and the Amendments shall be subject to approval by the ASUC cabinet.

7.2 The HKSA shall be liable for damages to properties of ASUC or the University of California.

7.3 The HKSA shall abide by the rules governing the use of the names and insignia of the University of California.

7.4 The HKSA shall accept and comply with any amendments to the Constitution within twenty university days after notification from the ASUC cabinet.

Article VIII. Amendments.

8.1 Amendments to the Constitution and the By-Laws may be proposed in a cabinet meeting or a general meeting. A written proposal must be provided to the cabinet.

8.2 Amendments to the Constitution and the By-Laws may be adopted with a favorable two-thirds majority vote of cabinet members present at a cabinet meeting.

8.3 All amendments shall be in consonance with the Office of Student Life within one week of adoption.
